Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement

At Lyme and Pickle Limited, we maintain policies, rules, and procedures ("Guidelines") to ensure the safe and enjoyable use of our facility, programs, and offerings. These Guidelines include those outlined in this document and any others that may be posted on-site or communicated to you. This Agreement outlines your responsibilities and legal obligations when using our premises, engaging in activities, or accessing any service, product, or equipment offered by Lyme and Pickle Limited.

This legally binding waiver and release ("Agreement") is between you (the participant) and Lyme and Pickle Limited ("us," "we," or "our"). The terms "Lyme and Pickle Limited," "we," or "us" extend to all affiliated parties including employees, directors, officers, agents, contractors, insurers, legal representatives, successors, and assigns. Similarly, "you" refers to yourself as well as any spouse, dependents, minors for whom you are legally authorized to provide consent, and your heirs or beneficiaries.

You are entering into this Agreement in consideration of being permitted access to Lyme and Pickle's premises and participation in any activities offered.

Premises refers to all property operated by Lyme and Pickle Limited, including indoor and outdoor spaces such as courts, restrooms, locker areas, children's areas, dining facilities, entryways, and parking areas.

Activities include, but are not limited to, all forms of pickleball play (games, tournaments, training), organized events, classes, fitness sessions, private rentals, social gatherings, and any service or event provided, organized, or affiliated with Lyme and Pickle.

By signing below or checking the applicable box online, you confirm that you have read, understood, and voluntarily agree to the terms in this Agreement.

You are expected to comply with all Guidelines at all times. A current version of this Agreement can be found at: www.lymeandpickle.com. We reserve the right to update our Guidelines or terms of use. While material changes to this waiver will require your explicit consent, your continued participation following any updates will signify acceptance of those changes.

Health and Safety

We prioritize your safety, but cannot eliminate all risk. You acknowledge that despite the implementation of reasonable safety measures, the possibility of physical injury, illness, or other harm still exists ("Risks").

You agree to use appropriate clothing and gear and to take full responsibility for yourself and any minors under your care while on the premises or participating in any activities.

Assumption of Risk

In return for access to the premises and participation in Lyme and Pickle's activities, and with full awareness of potential Risks, you accept all responsibility for yourself and any minor(s) for whom you provide consent. You acknowledge and agree that:

WAIVER AND RELEASE OF CLAIMS

For yourself and for any minor(s) under your care, and on behalf of your heirs, successors, personal representatives, and assigns, you hereby ASSUME ALL RISK related to use of the premises and participation in activities, and agree to RELEASE, WAIVE, AND DISCHARGE Lyme and Pickle Limited and its affiliates, officers, agents, employees, contractors, insurers, and representatives (collectively, the "Released Parties") from any and all liability or claims that may arise.

This release includes, but is not limited to, any claim of injury, illness, or damage—whether physical, mental, emotional, or financial—that results from:

• Use of Lyme and Pickle's facilities, services, or equipment,
• Participation in any activities, whether supervised or unsupervised,
• Alleged negligence or misconduct of any Released Party or other participants.

This release applies whether the claim is brought by you or another party on your behalf and includes claims brought against you by other participants or spectators.

Minor Participation (if applicable)

If you are the parent or legal guardian of a minor participant, you confirm that:

• You are authorized to provide consent on their behalf;
• You understand the nature of the activities offered;
• You have considered their health, fitness, and abilities and believe they are capable of safely participating.

Acknowledgment of Potential Negligence

You understand that "negligence" may include—but is not limited to—improper facility maintenance, unsafe conditions, insufficient staffing or training, or data breaches relating to personal information. This Agreement releases Lyme and Pickle Limited from liability even in cases of alleged negligence, unless prohibited by law.

Medical Readiness and Responsibility

You affirm that you and/or the minors for whom you provide consent are in adequate physical health to participate and do not have any condition that may endanger yourselves or others. You take full financial responsibility for any emergency medical treatment or services that may be required during your time at the facility.

Legal Costs and Enforcement

If Lyme and Pickle Limited must defend this Agreement in court or otherwise enforce its terms, you agree to pay all legal costs, including attorney fees, if we are determined to be the prevailing party.

Final Provisions

This document reflects the entire understanding between the parties and supersedes all prior agreements or discussions related to the subject. Any amendments must be in writing and signed by both parties. Electronic signatures and copies are acceptable. If any part of this Agreement is found to be unenforceable, the remaining provisions shall remain in full effect.
